Research question
What do “law of the land”, domestic admiralty law and international law of the sea each mean in their own legal setting?
Verified fact
Admiralty and maritime law are genuine legal fields. The Federal Court identifies its jurisdiction under the Admiralty Act 1988 (Cth), including claims such as ships, cargo, collisions, salvage, marine insurance, seafarers’ wages, towage and carriage by sea.
Evidence limits: The existence of admiralty jurisdiction does not determine the jurisdiction of every dispute; the Act and the particular claim control.
Primary legal authority
The Admiralty Act 1988 (Cth) expressly provides for admiralty jurisdiction in personam and for actions in rem. An in rem action is directed against qualifying maritime property; an in personam proceeding is directed against a person or organisation.
Evidence limits: These are maritime procedural concepts. They do not establish that ordinary birth registration or an administrative name format creates admiralty jurisdiction.
Historical information
“Law of the land” is a genuine historical legal expression. In this resource it is used descriptively for the law governing the relevant jurisdiction; it is not treated as a separate rule that overrides the applicable statute, court or jurisdiction.
Evidence limits: A historical expression does not decide a modern legal question without the applicable current authority.
